Constitutional Court of Bosnia and Herzegovina confirmed the constitutionality of the Federation of Bosnia and Herzegovina Land Registry Law

At 110th plenary session held 31 May 2018, Constitutional Court of Bosnia and Herzegovina has decided and held a preliminary discussion about the request for review on constitutionality in case No U7/18 regarding the request of the 29 members of the National Assembly Republic of Srpska, regarding the request for review onconstitutionality of Federation of Bosnia and Herzegovina Land Registry Law.

Constitutional Court of Bosnia and Herzegovina has determined that the provision of Articles 63, 66, 67, 70, 71, 72 and 76 of the Federation of Bosnia and Herzegovina Land Registry Law are in accordance with Article II/3.e) Constitution of Bosnia and Herzegovina and Article 6 of European Convention, Article II/3.k) of the Constitution of Bosnia and Herzegovina, Article 1 of the Protocol No 1 within the European Convention, European Convention Article 13 related to the right for fair trial and the right to property and Article II/4. Constitution of Bosnia and Herzegovina and European Convention Article 14 related to the right for fair trial and the right to property.

With this decision of the Constitutional Court of Bosnia and Herzegovina is confirmed constitutionality and legality of the procedures for establishment and replacement land register in Federation of Bosnia and Herzegovina within the Real Estate Registration Project.
