Adopted amendments to regulations in the land administration sector of Federation of BiH

House of representatives of the FBIH Parliament and House of peoples supported the proposals for the amendment of Law of survey and cadastre, Law on survey and cadastre of land and Law on land registry of Federation of BiH on sessions held on 26 and 28 July 2022. The Laws were prepared by the Federal Geodetic Administration and Federal Ministry of Justice.

The Director of the Federal Geodetic Administration, Mr. Željko Obradović presented the proposals and pointed out the reasons for adoptions. Namely, the proposals were proposed with the aim of improving the real estate registration system at the area of the Federation of BiH where the modernization and harmonization between cadastre and land registry has been systematically undertaken through the Real Estate Registration Project (supported by the World Bank credit loans) since 2013.

The implementation of projects activities resulted with 57,9% land registry inserts which are based on the new cadastral survey, which should be kept in mind that project is focused on the urban areas. As a part of the project activities was also made the new Feasibility Study of new architecture and software for FBIH land registry and cadastre information system, where were recognized the obstacles and weaknesses that the existing legal framework represents for the system development. As a special risk was detected the possibility of data disharmony within which was required a lot of effort and resources, precisely because of the dual registration system and insufficiently defined procedures related to the obligation of harmonization between cadastre and land registry.

In order for citizens and the business community not to suffer due to the complexity of the administrative and legislative procedures, an attempt will be made to increase the level of integration in the maintaining cadastre and land register data, through proposed amendments to the current Law of survey and cadastre, Law on survey and cadastre of land and Law on land registry of Federation of BiH, with a focus on those areas and real estate that have undergone the harmonization process.
